What Is A Managing Agent?

A managing agent is usually a company that is chosen by a property’s landlord to manage the building on their behalf. This involves a variety of tasks such as collecting service charges from the property’s residents. What Does A Managing Agent Do?

In short, managing agents manage properties by following the terms of the lease whilst also ensuring that all statutory requirements are adhered to. We are proud to say that all of our team are well versed in every aspect of this field. This includes a good knowledge of landlord and tenant law, health and safety regulations, building construction, accounting, etc.

For the benefit of complete clarity, all of the tasks that a managing agent is asked to perform are placed in a contract, known as the management agreement, and signed by both parties. These agreements can be tailored on an individual basis as we understand that every property is different and therefore will have different requirements.

Managing Agent’s Duties

The duties that a managing agent may be asked to perform can be split up into a number of categories. Below we will list these categories along with a brief description of the roles.

Financial

These tasks relate to the monetary side of the lease agreement and ensure that all funds are in the correct places at the right times. Some of these roles include handling bank accounts, collecting service charges and the payment of wages/invoices.

Leaseholder and Tenant Relationships

A managing agent is also responsible for establishing and maintaining healthy relationships with Leaseholders/Tenants. This involves responding to and resolving enquiries raised by leaseholders or Tenants.

Lease Compliance

The lease compliance role simply means to make sure that the lease agreement is adhered to. If the lease agreement is broken, then the managing agent may have to represent the landlord at County Court, arbitration and tribunals.

Risk Management, Fire And Health & Safety Compliance

Regular checks and tests should also be arranged by managing agents to certify that a property is safe to reside in. These can include fire assessments, health and safety checks, as well as asbestos and legionella tests. A comprehensive risk assessment should be written up too.

Repairs & Maintenance

Should a property require any repairs or maintenance, then it is the managing agent’s role to organise a site inspection and ensure that the work is carried out in a quick and efficient manner.

Supporting The Landlord

One of the most important roles of a managing agent is to support the landlord as and when they need it. This may involve advising them on procedures and policy, as well as reporting on financial, maintenance and legal matters, plus leaseholder communications.
